Validity

The customer accepts the following general trading conditions for the duration of the entire business relation.

Agreements, which deviate from the points specified here, require writing.

Offers and contract conclusion

My offers are noncommittal. The quoted prices are net prices. The legal VAT won't be imposed.

After an offer the contract becomes valid by an order of the customer.

Duration of contract and termination

The contract has an unrestricted term. Regardless of this each party is entitled to quit this agreement with an adherence to an one month period. Terminations require writing.

Servicing contracts are concluded - if not agreed differently - for an indefinite time and can be terminated by both parties with a period of three weeks always to the quarter end.

Terms of payment

My works are immediately to pay after invoice receipt, at the latest 10 days from invoice date without deduction.

In default of payment 14 % interest on arrears are charged per annum.

Retention of title

My whole work remains my property up to the complete payment.

Liability

The customer alone is responsible for the contents of the web pages and assures that no rights of third parties and legal laws are broken (labels -, names -, authors -, data protection laws and so on).

Claims for damages against me are excluded, except by intentional or grossly negligent actions.

For server problems, disturbances within the Internet and intervention from third parties on the web pages, which are not under my control, I'm not liable. If the orderer (or a third party) updates or changes the web pages, I take over no legal liability for all consequences. Liability and claims for damages are limited to the order value.

The customer is responsible for backup his data. As far as further maintenance services do not take place via me, the orderer is responsible for the backup of the data himself and exempts me from obligation to keeping the created data. In the case of a maintenance contract modifications have only carry out by myself.

Final clauses

With ineffectiveness by one of the conditions, the effectiveness of the remaining keeps unaffected.

Legal domicile is Friedrichshafen (local court at Tettang, Germany), it applies the right of the Federal Republic of Germany.
